  • ARTICLE 1 – DEFINITIONS
  • In these Terms and Conditions, the following definitions apply:
  • Consumer: A natural person purchasing products or services from Whipstar for personal, non-commercial use.
  • Entrepreneur: Whipstar, providing products and/or services remotely.
  • Distance Contract: A sales agreement conducted entirely through remote communication methods.
  • Right of Withdrawal: The consumer’s right to cancel the distance contract within a specific withdrawal period.
  • Withdrawal Period: The time frame in which a consumer can exercise their right of withdrawal.
  • Durable Medium: Any method enabling the consumer or entrepreneur to store personal information for future reference without alteration.
  • Model Form: The standard withdrawal form provided by Whipstar.
  • General Terms and Conditions: These Whipstar Terms and Conditions.

  • ARTICLE 3 – APPLICABILITY
  • These terms apply to all offers, orders, and distance contracts between Whipstar and consumers.
  • The consumer will have access to these terms before concluding any distance contract. If electronic storage or review is impossible, Whipstar will indicate where terms can be accessed or provide them upon request.
  • Any specific terms for certain products or services supplement these general terms. If inconsistencies arise, the terms most favorable to the consumer apply.
  • Should a provision become invalid, it will be replaced with a valid provision reflecting its original intent. Situations not explicitly covered will be interpreted according to these terms' spirit.
  • ARTICLE 4 – THE OFFER
  • Offers explicitly state any conditions or duration limitations and are non-binding, with Whipstar reserving the right to modify offers.
  • Descriptions and images provided accurately represent products or services. Obvious mistakes or typographical errors in an offer are non-binding.
  • Each offer clearly outlines:
  • Total price, including taxes
  • Shipping costs
  • Contract conclusion procedures
  • Applicability of the right of withdrawal
  • Payment and delivery methods
  • Acceptance period of the offer
  • Archiving details of the contract
  • Language availability of the contract
  • ARTICLE 5 – THE AGREEMENT
  • The contract is effective upon consumer acceptance of the offer and fulfillment of stipulated conditions.
  • Electronic acceptance will be promptly confirmed. Whipstar implements security measures to protect electronic transactions and data.
  • Whipstar may assess a consumer's ability to fulfill payment obligations and reserves the right to decline orders based on such assessments.
  • Upon acceptance, consumers will receive written or digital confirmation of:
  • Withdrawal conditions
  • Post-purchase guarantees and support details
  • Information referenced in Article 4
  • Conditions for contract termination (if applicable)
  • Contracts depend on product availability.
  • ARTICLE 6 – THE PRICE
  • Prices remain fixed during the offer period unless influenced by VAT rate changes or external market fluctuations, which Whipstar cannot control.
  • Whipstar is not liable for typographical errors in pricing; incorrect pricing does not obligate Whipstar to deliver products at erroneous prices.
  • ARTICLE 7 – CONFORMITY AND GUARANTEE
  • Whipstar guarantees products/services meet agreed specifications, normal usability expectations, and comply with applicable laws.
  • Defective or incorrect deliveries must be reported within 4 weeks, and returns must be in original, unused condition.
  • Warranty terms match manufacturer warranties, but Whipstar isn't responsible for product suitability in all specific consumer applications.
  • The warranty is void if products are modified, misused, or improperly handled.
  • ARTICLE 8 – DELIVERY AND EXECUTION
  • Whipstar diligently processes orders. Deliveries occur at consumer-specified addresses within 30 days unless otherwise agreed.
  • Whipstar will notify consumers promptly if delays or order issues occur, allowing cancellation without penalties but excluding compensation.
  • Delivery timelines are indicative only, and delays do not warrant compensation claims.
  • Whipstar assumes risk until product delivery or designated recipient acceptance.
  • ARTICLE 9 – DURATION
  • Contracts lasting over one year can be terminated by consumers after one year with a one-month notice.
  • ARTICLE 10 – PAYMENT
  • Payments are due within 7 business days from the start of the withdrawal period or contract confirmation for services.
  • Consumers must promptly report payment inaccuracies. In case of consumer payment default, Whipstar can charge reasonable costs.
  • ARTICLE 11 – COMPLAINTS PROCEDURE
  • Whipstar maintains a clear complaint resolution process.
  • Complaints must be detailed and submitted within 7 days of detecting an issue. Whipstar will respond within 14 days, with extended cases receiving timely status updates.
  • If unresolved mutually, complaints may proceed through official dispute resolution channels.
  • Valid complaints result in product replacement or repair by Whipstar.
  • These terms and consumer agreements are governed by Malta Law
  • ARTICLE 13 – ADDITIONAL OR DIFFERENT PROVISIONS
  • Additional or differing terms, not detrimental to the consumer, must be clearly documented and provided to consumers in an accessible format.
